1. Acceptance of Terms

By accessing or using Field PM ("the Service"), operated by Field PM ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including company administrators, project managers, superintendents, foremen, subcontractors, and customers.

2. Description of Service

Field PM is a cloud-based construction project management platform that provides daily reporting, job book management, budget tracking, invoicing, quality control, safety reporting, and related tools for construction companies and their teams.

3. Accounts and Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • Company administrators are responsible for managing user access within their organization

4. Subscription and Billing

  • Field PM offers a 14-day free trial for new accounts
  • After the trial period, a paid subscription is required to continue using the Service
  • Subscription plans are billed monthly or annually as selected at checkout
  • Payments are processed securely through Stripe
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Refunds are not provided for partial billing periods
  • We reserve the right to change pricing with 30 days' notice to existing subscribers

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without written consent
  • Use the Service to store or transmit content that infringes intellectual property rights

6. Your Data

  • You retain ownership of all data you upload or create using the Service
  • You grant us a limited license to store, process, and display your data solely to provide the Service
  • We will not access your data except to provide support, troubleshoot issues, or as required by law
  • You are responsible for maintaining backups of your critical data
  • Upon account termination, your data will be retained for 30 days before permanent deletion

7. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is owned by Field PM and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Field PM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Field PM does not warrant that the Service will meet your specific requirements or that it will be error-free.

11. Indemnification

You agree to indemnify and hold harmless Field PM, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your account if you violate these terms or engage in activity that harms the Service or other users. You may terminate your account at any time by canceling your subscription and contacting support. Sections regarding liability, indemnification, and intellectual property survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.
